Helping You Fight Wrongful Conduct by Debt Collectors

We aggressively protect the rights of men and women who have been unfairly or illegally treated by debt collectors or creditors. Specifically, we handle claims under:

  • The Fair Debt Collection Practices Act (FDCPA). The FDCPA is a federal law requiring 3rd party debt collectors to use fair and honest tactics in attempting to collect debts. Under the FDCPA, collectors cannot engage in certain activities, such as making threats, pretending to be attorneys, calling at unreasonable hours or calling in a way that constitutes harassment. There are also restrictions on the content and language of mailings.

If a debt collector has violated the FDCPA, you can file a lawsuit seeking damages. The amount of damages is limited under the statute, but the prevailing party is also entitled to attorney fees.

  • The Fair Credit Reporting Act (FCRA). The FRCA addresses issues of abuse in credit reporting, prohibiting the use of derogatory, untrue or factually incorrect transfers of information to credit reporting agencies. This can include false reports of default, late payments or other financial information. Often, a debt collector will improperly report you to a credit reporting agency in an effort to get you to cooperate.
